Service Description
Minnesota Pest Control provides professional pest management and wildlife control services to residential and commercial customers throughout the State of Minnesota. Our services include, but are not limited to, inspection and identification of pest activity, implementation of integrated pest management programs, application of EPA-registered pesticides and rodenticides, trapping and removal of nuisance wildlife, exclusion work to prevent pest entry, and ongoing monitoring and maintenance programs. Service visits are scheduled during normal business hours, Monday through Saturday, with emergency services available for certain pest situations at our discretion. The specific scope of work, treatment methods, frequency of service, and pricing will be detailed in your individual Service Agreement or work order. We tailor our approach based on the pest species identified, environmental conditions, seasonal factors, and the unique characteristics of your property. All services are performed by licensed technicians in accordance with Minnesota Department of Agriculture regulations and applicable federal guidelines.
No Guarantee or Warranty
Minnesota Pest Control does not guarantee complete elimination of all pest activity from your property. Pest management is a dynamic process influenced by numerous factors beyond our control, including but not limited to: weather conditions, neighboring properties with unmanaged pest populations, structural conditions of buildings, sanitation practices, and pest biology and behavior. Results may vary based on these and other circumstances. We do not warrant that our services will prevent future infestations or that treated areas will remain pest-free for any specific duration. Any recommendations for structural repairs, sanitation improvements, or environmental modifications are advisory only, and failure to implement such recommendations may affect service outcomes. Our service warranties, if any, are limited to the specific terms set forth in your signed Service Agreement and do not extend beyond the express terms stated therein. No oral representations or promises made by technicians or staff shall create any warranty not expressly contained in writing.
User Responsibilities
As a customer receiving services from Minnesota Pest Control, you agree to provide accurate information regarding the nature and extent of pest activity on your property. You must ensure safe and reasonable access to all areas requiring treatment, including basements, attics, crawl spaces, and exterior perimeters. You are responsible for securing pets, removing or protecting food preparation surfaces, and following all pre-service and post-service instructions provided by our technicians. Failure to comply with safety instructions or technician directives may result in service delays, additional charges, or termination of service. You must disclose any known chemical sensitivities, allergies, or health conditions of occupants that may be relevant to treatment selection. For properties with wells, septic systems, or proximity to water bodies, you must inform us prior to service as special precautions may apply. You agree not to interfere with or remove bait stations, traps, or other installed equipment without prior consultation. Payment is due according to the terms specified in your Service Agreement, and you remain responsible for payment regardless of perceived service outcomes.
Limitation of Liability
To the maximum extent permitted by applicable law, Minnesota Pest Control and its officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to property damage, personal injury, lost profits, or business interruption, even if advised of the possibility of such damages. Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim during the twelve months preceding the incident. We are not responsible for damage to landscaping, irrigation systems, or structures resulting from necessary service access. You acknowledge that pest control treatments involve inherent risks, and you assume responsibility for ensuring that children, pets, and vulnerable individuals remain away from treated areas for the duration specified by our technicians. This limitation of liability applies regardless of the legal theory under which any claim is brought.
Intellectual Property
All content, materials, trademarks, service marks, logos, and intellectual property displayed on our website, marketing materials, and service documentation are the exclusive property of Minnesota Pest Control or its licensors. This includes but is not limited to our business name, logo, service descriptions, photographs, technical specifications, and proprietary treatment protocols. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any of our intellectual property without prior written consent. Customer-provided feedback or suggestions may be used by Minnesota Pest Control without obligation or compensation. Any unauthorized use of our intellectual property may result in legal action under applicable state and federal laws.
Governing Law
These Terms of Service and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms shall be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, or the county where the services were performed. You consent to the personal jurisdiction and venue of such courts. These terms are subject to all applicable Minnesota state regulations governing pest control operations, including Minnesota Statutes Chapter 18B and rules promulgated by the Minnesota Department of Agriculture. If any provision of these terms is found invalid or unenforceable under Minnesota law, the remaining provisions shall continue in full force and effect.
Changes to Terms
Minnesota Pest Control reserves the right to modify or update these Terms of Service at any time without prior notice. Changes become effective immediately upon posting to our website or upon your acceptance of a revised Service Agreement. We encourage you to review these terms periodically. Your continued use of our services after any changes constitutes your acceptance of the modified terms. Material changes affecting your rights or obligations will be communicated through the contact information you have provided. If you do not agree to the revised terms, you must discontinue use of our services and notify us in writing to terminate your Service Agreement, subject to any applicable termination provisions.
